Motion of No Confidence in Federal Government Administrator passes

27 November 2024

CFMEU members at the Victorian Branch meeting tonight unanimously passed a motion of No Confidence in the Federal Government Administrator, Mr Mark Irving KC.

Tim Gooden, who moved the motion, and a CFMEU member said, ‘We have been calling for accountability about our finances and what members’ money is being spent on. But the Administrator refuses to provide financial reports on how they are spending hundreds of thousands of dollars of members’ money. We also believe the Administrator is not following the law when it comes to termination of employees and officials.’

‘Members are also upset that construction workers are being killed at work – and the Administrator could not even be bothered to make a statement, let alone address the safety issues of the workers on site in Victoria,’ Gooden said.

‘We had a member die needlessly on site last week. We also have an Administrator, earning more than the Prime Minister, who can’t even pick up the phone and help the workers on site. Our previously elected officials would have been campaigning to prevent that death, and made sure the other workers on that site were being looked after.’

See below for the entire motion.

Motion

The members’ meeting of the CFMEU Victorian Branch considers the failures of the Federal Government Administrator to respond to the democratic requests of the branch members. Specifically, not providing:

  • ‘A written report to each monthly branch meeting, detailing the total terms and conditions of all persons plus contractors and corporations employed or contracted as part of the administration’;
  • ‘An accounting to the membership of all salaries and benefits paid from Union funds to the Administrator, State Executive Managers and any other individuals appointed by or units created by the Administrator’.

Furthermore, we consider the non-payment of legal entitlements to our elected officials when they were removed from office as unlawful and therefore as Wage Theft. And making no comment or taking no action in relation to deaths on site recently. Also, the unlawful termination of union employees as totally unacceptable.

This meeting condemns the actions of the Federal Government Administrator and has no confidence in their ability to be a democratic unionist in control of our union.  We call on the federal Minister, Mr Murray Watt, to dissolve the Administration and restore our democratically elected leaders.

This ‘no confidence motion’ to be made public via a general media release.
